General Conditions of Sale (GCS) - Food Products

Premise

These general conditions of sale (hereinafter “Conditions”) govern the purchase of food products (hereinafter “Products”) made through the Azienda Agricola Fratelli Saletti website.

The Site is owned and operated by Azienda Agricola Fratelli Saletti, with registered office in Catania (CT), Via Cagliari n.92, tax code and VAT number 03618070878, registered in the Catania Company Register with REA number CT- 245376 (hereinafter “Seller”).

Article 1 – Subject Matter

This agreement regulates the distance sale of the Products offered on the Website. By submitting an order, the Customer enters into an online sales contract with the Seller.

Article 2 – Acceptance of the Terms

These Terms are available on the Website at any time prior to placing an order. By completing and submitting an order, the Customer fully accepts these Terms without reservation.

Article 3 – Product Information

Product sheets contain descriptions of the essential characteristics of the products. The images are for illustrative purposes only and may not perfectly represent the actual product.
The Seller undertakes to provide clear and truthful information in compliance with current legislation, including EU Regulation 1169/2011 on food labelling. 
Product data sheets include, where applicable: the product's legal name; ingredients and allergens; net quantity; storage conditions; best before date or expiration date; origin or provenance; and manufacturer's information.

Article 4 – Prices and Shipping Costs

Online sales are governed by Italian Legislative Decree No. 206/2005 (Consumer Code) and Legislative Decree No. 70/2003 on electronic commerce.
All prices are expressed in Euro and include VAT unless otherwise specified. Shipping costs are calculated and clearly displayed before the order is confirmed.
Any promotional offers are valid for the period indicated on the Website.

Article 5 – Orders and Payments

The Customer selects the desired Products, adds them to the cart, and completes the purchase by following the guided procedure. Orders are normally processed within 72 business hours of payment confirmation.

Accepted payment methods:

– Credit card (Visa, Mastercard)
– PayPal
– Advance bank transfer
– Google Pay
– Apple pay

In case of payment by digital merchant, the total amount will be charged at the time the order is confirmed. Payment data are processed directly by the payment provider and are not stored by the Seller.
For bank transfers, payment details will be provided after the order is placed. Orders will be processed only upon confirmation of receipt of funds. 

Article 6 – Delivery

Products are shipped to the address indicated by the Customer during the purchase process. Delivery times may vary depending on the destination and the courier used.

The Customer is required to check the integrity of the package upon delivery.

Article 7 – Right of Withdrawal

The Consumer, pursuant to articles 52 et seq. of Legislative Decree 206/2005 (Consumer Code), has the right to withdraw from the contract, without stating the reasons, within 14 (fourteen) days from the date of receipt of the Products.

To exercise the right of withdrawal, the Consumer must send an explicit communication to the Seller at the email address info@fratellisaletti.com, indicating the desire to withdraw from the purchase, as well as the order data.

The Consumer is required to return the Products to the Seller within 14 (fourteen) days from the date on which he communicated the withdrawal. The Products must be returned intact, unused, unopened, and in their original packaging.

The costs of returning the Products are borne by the Consumer.

The Seller will refund the amount paid for the returned Products within 14 (fourteen) days of receiving them and after verifying their integrity. The refund will be made using the same payment method used by the Consumer for the initial transaction, unless otherwise agreed between the parties.

Article 8 – Liability

The owner of the website www.fratellisaletti.com cannot be held responsible for delays or failure to fulfill its contractual obligations if this is due to force majeure, such as, but not limited to, accidents, explosions, fires, strikes, lockouts, transport disruptions, earthquakes, floods, extraordinary natural events, health emergencies, interruptions of telecommunications networks, or other unforeseeable events beyond the Seller's control.
In the cases of force majeure referred to above, the Seller shall not be held liable for any damages, losses, or costs incurred by the Customer resulting from the failure or delay in fulfilling the contract. In such cases, the Customer shall be entitled exclusively to a refund of any amount already paid for undelivered Products. 

Fratelli Saletti is not responsible for any fraudulent or illicit use of credit cards or other payment instruments by third parties when paying for Products purchased on the Site. The Seller does not possess the complete payment instrument data used by the Customer, which is transmitted via a secure connection directly to the payment service providers and processed in accordance with the security standards required by applicable legislation.

Article 9 – Intellectual property

Trademarks, logos, texts, images and other content on the Website are the exclusive property of Azienda Agricola Fratelli Saletti or their respective owners and may not be used without prior authorization.

Article 10 – Disputes and Competent Court

For any dispute concerning the interpretation or execution of this contract, if the Customer is a consumer, the court of the consumer's place of residence or domicile shall have jurisdiction, as provided by law. In all other cases, the court of Catania shall have exclusive jurisdiction.
